The Public Service Commission (PSC) has cautioned all public officers against engaging in political activities ahead of the upcoming November 27, 2025 by-elections, warning that those who flout the law will face disciplinary action.
The warning follows an announcement by the Independent Electoral and Boundaries Commission (IEBC) to fill 24 vacant seats in Parliament and various County Assemblies. PSC Vice Chairperson Mary Kimonye said the Commission is closely monitoring compliance with laws governing neutrality in the public service.
In her statement, Ms. Kimonye reminded public officers of the need to maintain political impartiality and uphold the integrity of the civil service. “The Commission reiterates that any officer found in breach of these provisions will face disciplinary action in accordance with the applicable public service regulations,” she said.
Kimonye further explained that under Section 43(5A) of the Elections Act, any public officer intending to contest in the by-elections must resign within seven days of the declaration of the vacancies. She also cited the Political Parties Act (Cap. 7D), which bars officers from acting as agents or showing public support or opposition to any political party or candidate.
The circular also referenced Section 25(1) of the Conflict of Interest Act, 2025, and Section 24 of the Public Service Code of Conduct and Ethics (Revised 2016), which collectively prohibit public servants from engaging in any activity that compromises or appears to compromise their neutrality.
PSC has directed all state departments and public agencies to submit the names of officers who have resigned to participate in the by-elections and to enforce strict compliance with the circular. Heads of departments have been instructed to take immediate administrative action in case of violations, as part of efforts to protect the integrity and neutrality of Kenya’s public service.
