Constable Admits Buying Alcohol for Fatal Assault Team

A shocking affidavit filed with the Independent Policing Oversight Authority (IPOA) has revealed that inmates who fatally assaulted teacher and blogger Albert Ojwang at a Nairobi police station were allegedly paid Sh2,000 to “discipline” him, not kill him.

In a sworn statement dated June 13, Police Constable James Mukhwana admitted receiving the Sh2,000 from a senior officer to facilitate the beating. He claims the money was used to purchase alcohol for four remandees assigned to carry out the assault.

“This is the truth of what happened. Ojwang was not meant to be killed but to be disciplined,” Mukhwana stated.

According to the affidavit, Mukhwana said he was briefed on the plan by a senior officer, after which he approached a remandee he had known for a long time to coordinate the act. His colleague was also allegedly informed of the operation.

“I told my colleague kuna mahabusu anakuja, boss anataka mmushughulikie kidogo,” he explained, adding that the lead remandee demanded alcohol before proceeding.

After handing over the money, Mukhwana went to the canteen, bought alcohol, and gave it to the inmates. The assault took place between 9:30 pm and 10:00 pm in “the last cells,” located near the toilet block.

Mukhwana claimed his colleague helped by assuming sentry duties and summoning the selected inmates into the holding area where the attack occurred.

Expressing remorse, Mukhwana added, “I am sorry for the death of Ojwang. May God help them heal from the loss. I know it is painful.”

IPOA is continuing investigations into the incident that has sparked national outrage over custodial abuse and police accountability.
