The defamation case against Kikuyu MP Kimani Ichung’wah has been adjourned to the following week to allow all parties to submit their responses. City lawyer Danstan Omari has filed a lawsuit against the legislator, seeking compensation of Sh11 million for alleged damages. Omari claims that Ichung’wah posted a tweet stating that he frequents the notorious Koinange Street.
Magistrate Caroline Kemei has directed that the matter be mentioned on July 5th, once both parties have complied with the court’s directions. Although the case was scheduled for a hearing, Omari’s legal team informed the court that Ichung’wah had not responded to their application. Conversely, Ichung’wah’s lawyers stated that they had submitted a defense and a counterclaim on Monday morning and assured the court that they would serve Omari with the relevant legal documents. The court has given Ichung’wah seven days to file his response to the application, while Omari has been granted three days to file an additional affidavit.
Back in April, Omari had sent a demand letter to Ichung’wah, giving him a seven-day ultimatum to retract his statement and issue an apology. However, Ichung’wah refused to comply with the demands. In his petition to the court, Omari is seeking Sh11 million in damages, encompassing both general and aggravated damages, as a result of the tweet in question.
