KDF Officer Found Guilty of Defiling 16-Year-Old Girl

Kenya Defence Forces (KDF) officer stationed at Mtongwe Naval Base, George Odhiambo Owino, has been found guilty of committing difilement offense between the dates July 3 and November 16, 2020.

While giving her testimony before the Mombasa Court, the victim revealed that the officer approached her and seduced her promising to settle her school fees if she accepts to be his girlfriend, an incident she explained happened when she was in Form Two.

Furthermore, the girl told the Court that they had sexual encounters multiple times at her home, where Owino came, while her mother was away leading to her pregnancy, which Owino admitted responsibility for but failed to provide adequate support after he gave birth in April 2021.

“She stated that they had sex four times in their home and later discovered that she was pregnant around August 2020,” the court papers read.

The court was told that Owino only sent Ksh. 10,000 to fulfil his promise of taking care of the victim, but his hands went short and he sent no money afterwards.

In his defence, Owino claimed he was unaware of her age, that the girl had a big body which seem impossible to tell she was young. He suggested that their relationship was consensual. The court, however, ruled against Owino’s defence convicting him of defilement and committing an indecent act with a child under the Sexual Offences Act.

Owino said they got used to each other to an extent the girl would pay him a visit at the barracks, could cook for him and handle some chores in his house.

“They got used to each other and the complainant would go to his house and he asked her for a relationship. It was his defence that he didn’t know she was under 18 years old and he withdrew from the relationship,” court papers further read.

The man was found guilty of defilement, contrary to Section 8(1) as read with Section 8(4) of the Sexual Offences Act of 2006 and committing an indecent act with a child, contrary to Section 11(1) of the Sexual Offences Act.
