Former Senator Anwar Loitiptip Faces Charges of Fraud and Deception

In a recent court appearance, former Lamu Senator Anwar Loitiptip found himself at the center of legal proceedings, facing charges related to fraud and deception. The charges stem from alleged activities that took place on August 3, 2022, in an undisclosed location within the country.

Loitiptip was accused of unlawfully creating a motor vehicle registration certificate, claiming it to be a legitimate document issued by the National Transport and Safety Authority (NTSA). Additionally, he faced another charge of knowingly and fraudulently presenting a forged motor vehicle registration certificate to businessman Samson Malonza, purporting it to be genuine for motor vehicle registration number KDA 005C. The court heard that these actions transpired in the upscale Kileleshwa area in Kilimani.

Moreover, the former senator was accused of obtaining Sh6 million from Samson Malonza under false pretenses. It was alleged that Loitiptip falsely represented that he was in a position to sell a Toyota Land Cruiser V8 to Malonza, a claim he knew to be untrue.

During the court proceedings before Milimani Senior Principal Magistrate Gilbert Shikwe, Anwar Loitiptip vehemently denied all charges, including obtaining money by false pretense and uttering false documents. Representing himself, he pleaded for lenient bond terms, stating that the charges against him were malicious.

“I am a law-abiding citizen…the charges against me are malicious. The car was stolen while I was busy campaigning when the alleged vehicle is said to have been stolen,” Anwar told the court. He further asserted that he hails from Lamu and is currently facing financial difficulties after losing in the previous year’s election.

“Am bankrupt now. Please give me lenient bond terms,” he implored the court. Additionally, Loitiptip informed the court that the complainant, Samson Malonza, was a good friend, and they had an agreement. He expressed a willingness to transfer the vehicle’s logbook to Malonza or refund the money if the complainant desired.

He further explained that he is a regular family man who wishes to closely take care of his young family and therefore wouldn’t risk carrying out activities such as crime lest they unnecessarily separate him from his young family.

The former senator urged the court to consider his request for leniency, citing a medical condition that requires regular attention. Despite his pleas, the court released Anwar Loitiptip on a cash bail of Sh700,000 or a bond of Sh1 million, with a surety of a similar amount. The case is set for mention on November 30 for pretrial directions.

According to court documents, Loitiptip allegedly deceived businessman Samson Malonza by falsely claiming he could sell him a Toyota V8 SUV, leading to the alleged fraudulent acquisition of Sh6 million.

The charge sheets indicated that on August 3, 2022, in Kileleshwa, Kilimani sub-county within Nairobi County, Loitiptip knowingly and fraudulently presented a forged motor vehicle registration certificate to Samson Malonza, claiming it was a genuine document for motor vehicle registration number KDA 005C.

In his defense, Anwar Loitiptip maintained his innocence, asserting that he purchased the vehicle at Sh12 million from Malonza, a friend, but sold it at Sh6 million to fund his political campaign. The former senator, facing financial challenges after his election loss, expressed a desire to settle the matter amicably with the complainant.

The case has garnered attention not only for the legal intricacies but also for the personal and political dimensions involved. As Anwar Loitiptip navigates the legal process, the public awaits further developments in this high-profile case that intertwines allegations of fraud, deception, and a strained political landscape.
