The Ministry of Information, Communications and the Digital Economy has opened a fresh review of proposed ICT regulations. The public and industry stakeholders will take part in a three-day virtual validation exercise starting September 15, 2026.
The exercise will focus on revised draft regulations covering licensing, broadcasting, postal services and electronic communications. It will also examine rules on numbering, competition, tariffs and infrastructure sharing.
The Ministry said the regulations were developed through consultations with the Communications Authority of Kenya. A Regulatory Impact Assessment was also conducted as part of the process.
The ministry further said the review included public participation. This followed an earlier notice issued on August 26, 2025.
Submissions received during the consultations were considered in revising the draft regulations. The revised documents and the Regulatory Impact Statement have also been made available to the public.
The ministry said the regulations are being developed under the Kenya Information and Communications Act and the Statutory Instruments Act. The process is also guided by constitutional requirements on public participation.
“The formulation of the Regulations has undergone an extensive stakeholder engagement process, including public participation,” read in part the ministry’s public notice.
The first validation session will be held on September 15 from 9am to noon. It will cover five sets of proposed regulations. These include the General Licensing and Broadcasting Regulations. They also cover Postal and Courier, Type Approval of Electronic Communications Equipment and Numbering Regulations.
The second session will take place on September 16 at the same time. Stakeholders will review rules covering radio communication and frequency spectrum. The session will also examine competition, tariffs and interconnection. Infrastructure sharing regulations will also be considered.
On September 17, participants will review another five sets of regulations. These will cover consumer protection, electronic certification and domain name administration. The final session will also examine compliance and enforcement. It will further consider regulations on the administration of the Universal Service Fund.
The ministry has invited members of the public and stakeholders to participate in the virtual exercise. Participants can register through the Microsoft Teams link provided in the notice.
The government said the exercise is part of efforts to strengthen Kenya’s ICT regulatory framework. It also aims to ensure that the regulations reflect views from affected stakeholders.
“The Ministry remains committed to ensuring transparency, stakeholder engagement, and inclusivity in shaping Kenya’s ICT sector and digital economy,” the notice stated.
