The High Court of Nairobi has given orders stopping appointment of Prof Kithure Kindiki as the new Deputy President of the republic of Kenya to replace the impeached Rigathi Gachagua.
This order aims to give room for the court to conduct hearing of a petition filed by Rigathi Gachagua’s team that bars appointment of any new DP.
Part of the notice order read, “That in the meantime, due to the issues raised in the petition and application, and the urgency demonstrated, a conservatory order is hereby issued staying implementation of the resolution by the Senate upholding the impeachment charges against the petitioner, the Deputy President of Kenya.”

Giving directives on Friday 18 and ordering the petitioner to issue the respondents with a file within the next 3-days, Justice Chacha Mwita acknowledged existence of serious constitutional issues raised by Gachagua’s legal team, that must be heard by a bench of a number of judges appointed by Chief Justice Martha Koome.
“The file be placed before the Hon. Chief Justice immediately for consideration in that regard and that the pleadings be served immediately and be responded to within 3 days after service,” read in part of the notice issued by the High Court.
The court further directed that “the matter will be mentioned before the bench to be appointed by the Chief Justice, for appropriate orders and action,” on October 24, and to be treated with uttermost urgency.
This comes even as 236 Members of Parliament on Friday 18, unanimously voted in support of President William Ruto’s nomination to Prof Kithure Kindiki to be the new Deputy President replacing impeached Rigathi Gachagua
